PinkBeaux.com and TheBeauxBook.com (the “websites” or “sites”) are owned, operated, and maintained by PINK BEAUX LLC (“we”, “us” or “our”)

This agreement contains the terms and conditions (the “Terms of Use”) under which the sites offer you (the “user,”, “you,” or “your”), access to it and its Services (“services”) as defined below):

  • blog
  • newsletter
  • any published content created by us
  • any additional functionality and services offered through the sites

These Terms of Use govern the user’s access to the websites whether as a guest or a registered user.  Any new features or tools added to the websites shall also be subject to the Terms of Use.  These Terms of Use describe the user’s responsibilities and limit our liability. Before using any of our services, please read all these Terms of Use carefully. In the event that a conflict between these Terms of Use and any other provisions set forth on the sites, these Terms of Use will control.

Pink Beaux™, The Beaux Book™, Beauty Curated™, PinkBeaux.com and TheBeauxBook.com and all page headers, custom graphics and custom button icons are trademarks, of PINK BEAUX  LLC and may not be used in connection with any product or service that is not offered by PINK BEAUX LLC in any manner that is likely to cause confusion among customers. All other trademarks, product names and company names or logos cited herein are the property of their respective owners.

GENERAL TERMS

ELIGIBILITY

To access the websites and use its services you must be of legal age to form a binding contract in your jurisdiction.  If you are under the legal age to form a binding contract in your jurisdiction, you must have the consent of a parent or guardian to access our websites and/or services.

You must be 13 years or older to use the Site in compliance with the Children’s Online Privacy Protection Act (COPPA). If you do not qualify, please do not use the Site or Services.  If you do not qualify, please do not use the Site or Services.

The sites and its Services are administered in the United States and are intended for users residing in the United States. Any use outside of the United States is at the user’s own risk and international users are responsible for compliance with local laws.

USER INFORMATION

You understand that you may need to provide us with information (e.g. name, address, email address, credit card information) to use certain parts of the sites.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

PINK BEAUX is the exclusive owner of, or is authorized to use or provide access to, all parts of the websites, including all copy, software, graphics, designs, copyrights, trademarks and other intellectual property or proprietary rights contained therein.

Some materials on the websites belong to third parties who have authorized us to display the materials.  Except as expressly set forth in the Terms of Use, no license is granted to you and no rights are conveyed by virtue of accessing or using the website. All rights not granted under the Terms of Use are reserved by PINK BEAUX.

Subject to the Restrictions on Rights to Use in these Terms of Use, we hereby grant you permission to use the sites and services, provided that

You are authorized to use the sites and services solely for your own use, and you agree not to act on behalf of a third-party or to allow a third-party to have access to your password in order to use the sites and services. You are solely responsible for any and all activity that occurs on your account and you must keep your password secure. Furthermore, you shall not:

USER SUBMISSIONS

We encourage you to submit to the sites a variety of content (“user submissions”) in the form of comments and reviews. You understand that regardless of whether or not such user submissions are published, we do not guarantee any confidentiality. You shall be solely responsible for your own user submissions and the consequences of posting or publishing them. When publishing user submissions, you affirm, represent, and/or warrant that:

  • submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate,
  • post advertisements or solicitations for business, nor
  • impersonate another person.

We does not endorse any user submissions or any opinion, recommendation, or advice expressed therein, and we expressly disclaims any and all liability in connection with user submissions. We reserve the right to remove user submissions without prior notice. We will also terminate a user’s access to the sites and services if they are determined to be repeat offenders. We also reserve the right to decide whether a user submission is appropriate and complies with these Terms of Use for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or excessive length.

We may remove such user submissions and/or terminate a user’s access for uploading such material in violation of these Terms of Use at any time, without prior notice and at our sole discretion.

You understand that when using the sites and services, you will be exposed to user submissions from a variety of sources and that we are not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such user submissions.  You further understand and acknowledge that you may be exposed to user submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against us with respect thereto, and agree to indemnify and hold PINK BEAUX, its owners/operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site and services.

INTELLECTUAL PROPERTY RIGHTS

The content on the websites, with the exception of user submissions, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like (“content”) and the trademarks, service marks and logos contained therein (“marks”), are owned by or licensed to PINK BEAUX LLC, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Content on the websites is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. We reserve all rights not expressly granted in and to the websites and the content. You agree to not engage in the use, copying, or distribution of any of the content other than expressly permitted herein, including any use, copying, or distribution of user submissions of third parties obtained through the Site for any commercial purposes. You also hereby grant each user of the websites a non-exclusive license to access your user submissions through the websites and to use, reproduce, distribute, prepare derivative works of, display and perform such user submissions as permitted through the functionality of the websites and under these Terms of Use.

COPYRIGHT INFRINGEMENT POLICY

PINK BEAUX LLC does not permit copyright infringing activities and infringement of intellectual property rights on its websites, and will remove any content or user submissions if properly notified that such content or user submission infringes on another’s intellectual property rights. PRODUCTS, DESCRIPTIONS & WARRANTIES

PINK BEAUX reserves the right, at any time and without notice, to change its makeup, skin care, hair care, nail care, wellness, tools, and accessories (“products”) selection, description, photos, and prices.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us.

We have made every effort to display as accurately as possible the colors and images of our products that appear on the websites. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.

PRICED & MODIFICATIONS

Prices for all products are subject to change without notice.  We reserve the right to discontinue any product or service (or any part or content thereof) at any time. Any offer for any product or service made on this site is void where prohibited. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of said products and/or services.

Certain products or services may be available exclusively through our website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

ACCURACY OF SHIPPING, BILLING & ACCOUNT INFORMATION

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed fraudulently and/or by dealers, resellers or distributors.

PAYMENTS

All orders must be paid in full and in one transaction before the order is processed.  We currently accept American Express, Discover, Mastercard and Visa credit and debit cards.  We do not accept cash on delivery, money orders, wire transfers, or Pay Pal as a form of payment.

RETURN & EXCHANGE POLICY

We consider all sales final and will only consider issuing a refund if you receive an order with incorrect or damaged items.  Notification of incorrect or damaged orders must be received by us within 7 business days from the time you receive your order.  We do not process exchanges.

Lost orders must be reported to us within 2 business days from the time you receive your delivery notification and are all subject to a full investigation by the shipping carrier before a refund will be considered.

We reserve the right to not issue a refund for any reason at any time.

IDEMNIFICATION

NO AGENCY

You and PINK BEAUX LLC are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by these Terms of Use.

ASSIGNMENT

You may not assign these Terms of Use or any of your rights hereunder to a third person without first obtaining our express written consent.

GENERAL INFORMATION

GOVERNING LAW

THESE TERMS OF USE, AND ALL ASPECTS OF THE RELATIONSHIP AND DEALINGS BETWEEN YOU AND PINK BEAUX LLC, SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS WITHOUT REGARD TO ITS CONFLICT OF LAW PROVISIONS, I.E., AS SUCH LAW IS APPLIED TO TERMS OF USE, RELATIONSHIPS OR DEALINGS ENTERED INTO AND PERFORMED ENTIRELY WITHIN THE STATE OF TEXAS. IF YOU ARE UNWILLING TO HAVE TEXAS LAW APPLIED, DO NOT USE THE SITE. If any provision of these Terms of Use shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

COMPLETE TERMS OF USE

These Terms of Use and the materials expressly incorporated herein by reference constitute the full and complete Terms of Use between you and PINK BEAUX LLC. You and PINK BEAUX LLC have not relied upon any promises, representations, statements or undertaking other than those set forth herein. No oral modifications to these Terms of Use are permitted or valid.

JURISDICTION.

ANY LAWSUIT THAT ARISES BETWEEN YOU AND PINK BEAUX LLC IN CONNECTION WITH OR RELATED TO THESE TERMS OF USE, THE SITE OR THE SERVICES SHALL BE BROUGHT EXCLUSIVELY IN EITHER THE STATE OR FEDERAL COURTS IN THE CITY AND COUNTY OF HOUSTON. YOU AND PINK BEAUX LLC EXPRESSLY CONSENT TO THE EXCLUSIVE PERSONAL JURISDICTION OF SUCH COURTS.

SECTION HEADINGS

The section titles of these Terms of Use are for convenience only and have no legal or contractual effect.

SEVERABILITY

In the event that any provision of these Terms of Use is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Use, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Use are effective unless and until terminated by either you or us. You may terminate these Terms of Use at any time by notifying us that you no longer wish to use our services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Use, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our sites and services (or any part thereof).

ENTIRE AGREEMENT
